By accessing our website, using our Services, or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

Nothing in these Terms limits or excludes any mandatory consumer rights you may have under the laws of your country, state, or place of residence.

Our Services are not directed to children under the age of 16.

If we cancel an order after payment has been taken, we will issue a refund according to the original payment method, unless otherwise required by applicable law.

11 Payment

Payment must be made using one of the payment methods available at checkout.

By submitting payment information, you confirm that you are authorized to use the selected payment method and that the payment information provided is accurate.

Payments are processed securely by Shopify and/or third-party payment providers. We do not store full payment card details.

12. Shipping and Delivery

Shipping times, destinations, carriers, tracking, customs information, and delivery conditions are explained in our Shipping Policy.

Delivery times shown on our website are estimates unless expressly stated otherwise. They may vary depending on destination, carrier, customs clearance, local delivery conditions, and events outside our reasonable control.

If an order cannot be shipped within the stated or legally applicable timeframe, we will contact you where required and provide the options required by applicable law.

13. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, cancellations, defective products, damaged products, incorrect items, and delivery issues are handled according to our Return & Refund Policy.

You must follow the official return process before sending any product back to us. Products returned without authorization may be refused or delayed.

Nothing in these Terms limits your mandatory rights under applicable consumer protection laws.

14. Proper Product Use

You agree to use STARLESS products responsibly and in accordance with the instructions, warnings, safety information, and user manual provided with the product or made available by us.

The STARLESS portable espresso machine is an electrical product containing a rechargeable battery. You must use, charge, clean, store, and transport the product with care.

You must not misuse, modify, disassemble, tamper with, puncture, expose to fire, expose to excessive heat, submerge, or use the product in a way that is unsafe or contrary to the instructions.

15. Product Safety

You are responsible for reading and following all product instructions and safety warnings before use.

Do not use the product if it appears damaged, leaking, overheating, producing unusual smells, malfunctioning, or unsafe.

If you believe a product is defective or unsafe, stop using it immediately and contact us at hello@getstarless.com.

16. Limitation of Liability

To the maximum extent permitted by applicable law, STARLESS is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, or loss of opportunity arising from your use of the Services or products.

To the maximum extent permitted by applicable law, STARLESS is not responsible for damage caused by:

misuse of the product;
failure to follow instructions or safety warnings;
unauthorized modification, repair, or disassembly;
improper charging, storage, cleaning, or handling;
use with incompatible accessories or power sources;
normal wear and tear;
events outside our reasonable control.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for mandatory consumer rights that cannot be excluded under applicable law.

17. Mandatory Consumer Rights

Customers in certain countries, states, or regions may have mandatory legal rights, including rights relating to defective products, non-conforming goods, cancellation, withdrawal, refunds, repair, replacement, delivery, or consumer guarantees.

Nothing in these Terms, our Return & Refund Policy, or our Shipping Policy limits, excludes, or replaces any mandatory consumer rights that cannot be limited or excluded by law.

The STARLESS name, branding, visual identity, product presentation, and related content may not be used in a way that suggests affiliation, endorsement, or authorization without our permission.

If you submit a review, comment, photo, video, message, testimonial, or other content to STARLESS, you confirm that you have the right to submit that content and that it does not violate the rights of any third party.

By submitting content to us, you grant STARLESS a worldwide, non-exclusive, royalty-free license to use, reproduce, display, publish, adapt, and share that content for our website, marketing, advertising, social media, email, and promotional purposes, subject to applicable law.

You must not submit content that is false, misleading, abusive, illegal, defamatory, offensive, infringing, or otherwise inappropriate.

We may remove or refuse to display user content at our discretion where permitted by law.

23. Chargebacks and Payment Disputes

If you open a chargeback or payment dispute, we may provide Shopify, payment processors, banks, card networks, and dispute-resolution providers with relevant information, including order details, tracking information, delivery records, customer communications, and evidence related to the transaction.

24. Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including carrier delays, customs delays, strikes, natural disasters, technical issues, supply chain disruption, regulatory changes, payment provider issues, or other events beyond our control.

Where required by applicable law, we will provide the remedies required by law.
